Rep. Gingrey and Rep. Fleming Plan to Strengthen the Doctor/Patient Relationship with Medical Liability Reform

RSC Member Rep. Gingrey and Rep. Fleming will be introducing the Meaningful End
to Defensive Medicine & Aimless Lawsuits (MedMal) Act of 2010 in order to
strengthen the ability of doctors to work together outside of a court room.
Currently, attorneys, insurance companies, and hospital
administrators advise and sometimes even require that health care providers
avoid verbally addressing a medical incident with their patients because the
simple act of comforting a patient can be considered an acknowledgement of fault
in a court of law. Because of this fact – and other breakdowns in the
patient/doctor relationship – many patients see the court system as their only
source of recourse for a medical incident. The MedMal Act would
strengthen the efforts of physicians to comfort and compensate their patients
when a medical incident occurs. It would also give patients the opportunity to
receive compensation for a medical incident in a timely manner, and reduce the
amount of meritless claims that are filed each year by lawyers in search of a
big payday.
