Amendments to H.R. 2847SECOND RULE—The FY2010 Departments of Commerce and Justice, and Science, and Related Agencies Appropriations Act


 


The consideration of H.R. 2847, the FY2010 Departments of Commerce and Justice, and Science, and Related Agencies Appropriations Act (sponsored by Rep. Mollohan, D-WV), began on the House floor on Tuesday, June 16, 2009.  General debate was completed.  Amendment consideration, subject to the rule (H.Res.544) that contained a restrictive pre-printing requirement began.  Amendments number 11 (Mollohan) and number 8 (Schock) were agreed to by voice vote. 


 


Then Rep. Mollohan’s motion that the Committee of the Whole rise (i.e. temporarily stop considering amendments) passed on a near-party-line vote.  The Rules Committee then held a hearing on closing down the already-restrictive amendment process for this bill.  RSC Chairman Price asked that all amendments pre-filed by RSC members (except ones he knew were not going to be offered) be made in order under the new rule.  Such request was denied.


 


The new rule, H.Res. 552, is a structured rule, making only certain amendments in order (see below).  Specifically, there are:



Each amendment would be debatable for 5 minutes per side.  Members could NOT “move to strike the last word” in order to increase debate time.  No points of order would be available against the amendments, except if an amendment were offered at the incorrect point in the reading of the bill.


 


NOTE:  The Clerk will still read the bill by paragraph, thus amendments must be offered during the appropriate portions of the reading, NOT in numerical order according to their Congressional Record filing.


 


The Chair and the Appropriations Committee Ranking Member or their designees could each offer one pro forma amendment to the bill for the purpose of debate.  Such amendment could be repeated, but only after consideration of one of the amendments in the section of 23 amendments described above (and detailed below).


 


Under the rule, only the Appropriations Committee Chairman can make a motion to rise, and no motion to strike the enacting words of the bill would be in order (thereby removing yet another procedural tool of the minority).


 


One motion to recommit—with or without instructions—would be in order.

59. Broun (R-GA):  Prohibits funds from being used to establish or implement a National Climate Service.


 


60. Broun (R-GA): Prohibits funds from being used to carry out the statistical method known as “sampling” in the 2010 decennial census. “Sampling,” while already prohibited by statute, frequently skews statistical data to show certain results.


62. Quigley (D-IL): Prohibits funds from being used for the construction or rental of infrastructure that does not comply with both the General Services Administration Sustainable Design Program for Federal buildings and the Public Buildings Service Project Plan.


63. Nunes (R-CA):  Prohibits funds from being used to implement the biological opinion entitled “Biological Opinion and Conference Opinion on the Long-Term Operations of the Central Valley Project and State Water Project”, issued by the National Marine Fisheries Service and dated June 4, 2009.  According to the sponsor, the Biological Opinion is an attempt to protect salmon, steelhead, green sturgeon and killer whales.  It states that the species face dire environmental conditions unless irrigation from the federal Central Valley Project and the California State Project -- already at historic lows curtailed even further.  This new Biological Opinion will reduce Delta pumping by another 330,000 acre feet of water – this is on top of the water reductions included in the Delta-smelt Biological Opinion.  A revised University of California-Davis study found that up to 80,000 San Joaquin Valley jobs will be lost by the end of 2009 and 500,000 acres of productive farm land will be fallowed because of water rationing -- a direct result of these Biological Opinions.


69. Tiahrt (R-KS):  Prohibits funds from being used to obligate, or pay the salary or expenses of personnel who obligate, funds made available under the Economic Development Administration, Economic Development Assistance Programs; the National Telecommunications and Information Administration, Digital-to-Analog Converter Box Program; and the National Institute of Standards and Technology, Construction of Research Facilities.


71. Burton (R-IN): Prohibits funds from being used to relocate the Office of the Census or employees from the Department of Commerce to the jurisdiction of the Executive Office of the President. The purpose of this amendment is to limit the ability of White House to politicize the census process, which is supposed to be apolitical. 


93. Linder (R-GA):  Prohibits funds from being used to carry out or enforce section 5 of the Voting Rights Act of 1965, which mandates that certain states "pre-clear" any changes to their electoral practices.


 


96. Price (R-GA): Reduces total appropriations in Title II of the bill by $100,000,000 Department of Justice, the same level as President Obama asked his cabinet to save for all departments in April. 


 


97. Price (R-GA): Reduces total appropriations by $644,150,000.


 


98. Hodes (D-NH): Instructs the Director of the Office of Management and Budget to instruct any department, agency, or instrumentality of the United States Government to track undisbursed balances in expired grant accounts and include performance and accountability reports.


 


100. Jordan (R-OH): Provides a total funding level for the CJS bill equivalent to FY 2008 levels, saving taxpayers $12,511,000,000


 


102. Cuellar (D-TX): States that none of the funds made available in this Act may be used to purchase light bulbs unless the light bulbs have the ``Energy Star'' or ``Federal Energy Management Program'' designation.


 


111. Blackburn (R-TN): Reduces all appropriations in the bill by 5% across-the-board.


 


114. Reichert (R-WA): Increases by $2.5 million: Supporting Teens through Education and Protection program under the Violence Against Women’s Act; Reduces by $2.5 million: Departmental management--Salaries and expenses'.


 


118. Lewis (R-CA): States that none of the funds made available in this Act may be used to implement Executive Order 13492, issued January 22, 2009, titled Review and Disposition of Individuals Detained at the Guantanamo Bay Naval Base and Closure of Detention Facilities.

Some conservatives feel this form to be burdensome and intrusive.

Requires a state matching requirement or documented in-kind contributions of at least 33 percent of the Federal funds disbursed to States.

McCarthy (D-NY): Prohibits funds from being used to destroy any identifying information submitted to any system to implement section 922(t) of title 18 (regarding a national criminal background check system for firearms dealers and manufacturers), by an individual whose name appears in the Violent Gang Terrorist Organization File, or whose name appears on the terrorist watch lists maintained by the FBI.  Under current law, much of this information is destroyed if it involves an individual who clears his or her background check.


 


42. Roskam (R-IL): Reduces by $2 million (from $118,488,000): Department of Justice General Administration Salaries and Expenses; Increases the same account by the same amount ($2 million).


 


43. Blackburn (R-TN): Increases by $221 million: State and Local Law Enforcement Assistance; Reduces by $221 million: National Science Foundation Research and Related Activities.

49. Cassidy (R-LA): Strikes Section 212.  The section prohibits funds from being used for public-private competition for work performed by the Bureau of Prisons or of Federal Prison Industries, Incorporated.  The underlying bill prohibits funds from being used under OMB Circular A-76 (governing the federal government’s outsourcing policies) to implement any pending or future competitive sourcing for work performed by employees of the Bureau of Prisons or of Federal Prisons Industries, Incorporated.  In other words, the amendment will force federal employees to compete with private-sector entities for certain non-inherently governmental functions of the agencies (like food service and lawn-mowing.


 


50. Broun (R-GA):  Reduces by an amount equal to the unobligated balance (on the date of the enactment of this Act) the discretionary appropriations made available for such department or agency in division A of the American Recovery and Reinvestment Act of 2009.  According to the sponsor, the unobligated funds for Department of Justice are $1,200,677,000 and for Department of Commerce are $314,591,000.  This would be the amount of the reductions.  The bill itself calls for DOJ to be appropriated $27,746,672,000 and DOC, $13,847,433,000.  If enacted, the new levels for DOJ would be $26,545,995,000 and for DOC would be $13,532,842,000.


 


51. Heller (R-NV):  Prohibits funds for the State Criminal Alien Assistance Program under the heading “state and Local Law Enforcement Assistance” from being used for any State or local government that has any law, policy, or procedure in effect that circumvents the enforcement of any federal immigration law.


52. Bilbray (R-CA): Prohibits funds from being used to provide funds to any state of local government entity in violation of section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996.Section 642 states that a federal, state, or local official may not prohibit any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status of any individual. 


53. Gohmert (R-TX): Prohibits funds from being used to pay salaries or expenses related to, the Presidential Task Force on the Auto Industry.


 


54. McCaul (R-TX): Prohibits funds from being used for a project or program named for an individual then serving as a Member, Delegate, Resident Commissioner, or Senator of the United States Congress.


 


55. Wittman (R-VA): Reduces all appropriations in the bill by 0.5% across-the-board.


 


56. Wittman (R-VA): Reduces all appropriations in the bill by 1% across-the-board.


 


57. Wittman (R-VA): Reduces all appropriations in the bill by 2% across-the-board.


 


58. Broun (R-GA). Prohibits funds from being used to carry out or enforce section 5 of the Voting Rights Act of 1965, which mandates that certain states "pre-clear" any changes to their electoral practices.

Gingrey (R-GA): Prohibits funds from being used for the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives to pay the compensation of employees of the Bureau of Alcohol, Tobacco, Firearms and Explosives to test and examine firearms without written and published testing standards.


64. Posey (R-FL): Increases by $566 million: National Aeronautics and Space Administration (NASA) Exploration; Increases by $250 million the NASA Space Operations.


65. Burton (R-IN): Prohibits funds from being used to adjudicate or assist in a lawsuit about the definition of marriage as between a man and a woman.


66. Akin (R-MO): Prohibits funds from being used by the Bureau of the Census to provide any grant to or contract with any organization that has been indicted, or employ or contract with any individual who has been indicted, for a violation under Federal law relating to an election for Federal office.


67. Stearns (R-FL): Prohibits funds from being used for the Equal Employment Opportunity Commission for litigation expenses incurred in connection with cases commenced after the date of the enactment of this Act against employers on the grounds that such employers require employees to speak English.


68. Stearns (R-FL): Reduces all appropriations in the bill by 1% across-the-board.


70. Conaway (R-TX). Expresses a sense of the House of Representatives that any reduction in the amount appropriated by this Act achieved as a result of amendments adopted by the House should be dedicated to deficit reduction.


72. Burton (R-IN): Prohibits funds from being used to adjudicate or assist in a lawsuit seeking to prevent the enforcement of the Defense of Marriage Act.


73. Rogers (R-MI): Prohibits funds from being used to provide Miranda rights to detainees in the custody of the armed forces of the United States in Afghanistan.


74. Barrett (R-SC): Prohibits funds under the heading, “Violence Against Women Prevention and Prosecution Programs” for grants to combat violence against women, as authorized by part T of the Omnibus Crime Control and Safe Streets Act of 1968, from being used to carry out any activity not authorized under part T of such Act.  The amendment bars funds in the bill set aside for STOP (Services, Training, Officers, Prosecutors) Grants from being allocated to other programs. According to the sponsor, Congress has allocated funds provided for STOP Grants to Transitional Housing, National Institute of Justice, and other programs every year since FY2004. Congressman Barrett is NOT opposed to these other programs (Transitional Housing, NIJ, and others) being fully funded, but is opposed to their being funded through STOP Grant monies. 


75. Hensarling (R-TX): Prohibits funds from being used to enforce section 526 of the Energy Independence and Security Act of 2007. Section 526 prohibits federal agencies from entering into a contract for procurement of an alternative fuel unless the contract specifies that the greenhouse gas emissions are less than or equal to emissions from the equivalent conventional fuel.  The section was added to prevent the Defense Department from buying coal-based jet fuels.  


 


92. Lamborn (R-CO): Prohibits funds used by the Bureau of Prisons to incarcerate individuals currently held in the Naval Station, Guantanamo Bay, Cuba


 


94. Pence (R-IN): Prohibits funds to enforce provisions under the Bipartisan Campaign Reform Act (BCRA) prohibiting “electioneering communication.” The electioneering communications section of BCRA prohibits the use of corporate or labor union funds to pay for broadcast advertisements that include the name of a federal candidate within 30 days of a primary or 60 days of a general election.


 


95. Price (R-GA): Reduces total appropriations in Title I (Department of Commerce) of the bill by $100,000,000, the same level as President Obama asked his cabinet to save for all departments in April. 


 


99. Garrett (R-NJ): Prohibits funds from being used to make full or partial completion of the American Community Survey mandatory or to enforce civil penalties, including fines, for failure to complete the Survey in its entirety.  The American Community Survey is a more detailed questionnaire that asks individuals to provide demographic, housing, social, and economic information to the Census. Some conservatives feel this form to be burdensome and intrusive.


101. Bishop (R-UT): Allow for the enumeration, for purposes of apportionment, of American citizens living overseas during the decennial census (starting in 2010) who are not affiliated with the federal government and who either: take the steps to be enumerated through an international “Be Counted” form available at U.S. embassies or belong to an organization that chooses to submit administrative records to the Census Bureau


103. McDermott (D-WA): Prohibits funds from being used in contravention of section 307 of the Tariff Act of 1930 (19 U.S.C. 1307), which prohibits importation of "all goods, wares, articles and merchandise mined, produced or manufactured wholly or in part in any foreign country by convict labor."


 


109. Blackburn (R-TN): Reduces all appropriations in the bill by 1% across-the-board.


 


110. Cardoza (D-CA): Increases by $50 million: Federal Prison System--Salaries and Expenses for hiring additional corrections officers; Reduces by $50 million: National Science Foundation--Research and Related Activities' for the procurement of polar icebreaking services.  (The sponsor has stated the amendment will not be offered)


 


112. Blackburn (R-TN): Reduces all appropriations in the bill by 2% across-the-board.


 


113. Reichert (R-WA): Increases by $5 million: Supporting Teens through Education and Protection program under the Violence Against Women’s Act; Reduces by $5 million: Departmental management--Salaries and expenses'.


 


115. Tiahrt (R-KS): Prohibits funds to pay the salary or expenses of personnel, who obligate, funds made available under the Economic Development Administration--Economic Development Assistance Programs, National Telecommunications and Information Administration--Digital-to-Analog Converter Box Program, and National Institute of Standards and Technology--Construction of Research Facilities.


 


116. McHenry (R-NC): Prohibits funds from being used to allow the Bureau of the Census to carry out statistical sampling in violation of federal law. “Sampling,” while already prohibited by statute, frequently skews statistical data to show results that might reflect a particular political or social agenda.


 


117. Schock (R-IL): Prohibits funds made available in this Act may be used to pay the salary of any individual currently participating on the entity known as the ``Presidential Task Force on the Auto Industry''.


 


119: Lewis (R-CA):  States that none of the funds made available in this Act may be used to implement Executive Order 13492 issued January 22, 2009, titled Review and Disposition of Individuals Detained at the Guantanamo Bay Naval Base and Closure of Detention Facilities.


 


120. King (R-IA): States that none of the funds made available by this Act shall be made available to the Association of Community Organizations for Reform Now and specifically lists numerous state and local affiliates of ACORN.


 


121. King (R-IA): States that none of the funds made available by this Act under ``Bureau of the Census'' shall be made available to the Association of Community Organizations for Reform Now and specifically lists numerous state and local affiliates of ACORN.


 


122. King (R-IA): Prohibits funds from being used to employ “unauthorized aliens” of the Immigration and Nationality Act.


 


123. King (R-IA): States that none of the funds made available by this Act under ``Bureau of the Census'' shall be made available to the Association of Community Organizations for Reform Now (ACORN).


 


124. King (R-IA): States that none of the funds made available under this Act shall be made available to the Association of Community Organizations for Reform Now (ACORN).


 


125. Jackson-Lee (D-TX): Strikes language in the bill that prohibits the use of funds to release an individual detained at Guantanamo Bay prison as of April 30, 2009, into the United States.


 


126. Jackson-Lee (D-TX): Increases by $10 million: youth mentoring programs; Increases by $10 million:  Delinquency prevention programs; Reduces by $20 million: buildings and facilities for the federal prison system.


 


127. Jackson-Lee (D-TX): Strikes language in the bill that prohibits the use of funds to release an individual detained at Guantanamo Bay prison as of April 30, 2009, into the United States.
